The legal challenges of cohabitation
An increasing number of couples are either consciously choosing not to marry or, for a variety of reasons simply don’t make that choice. Despite the prevalence of cohabitation, however the law remains complex, outdated and some may well consider, unfair.
Resolution, the Association of Family Solicitors has launched a blue print for a future family justice system, campaigning for cohabitees to have at least basic rights on relationship breakdown or a death of their partner.
Currently the only protection that cohabiting couples have is firstly if they are included in the ownership of a property or have children where there are some protections, however limited, by Schedule 1 of the Children Act 1989.
